Privacy Policy & HIPAA Notice of Privacy Practices

This Privacy Policy is effective as of and was last updated on July 1, 2024.


THIS NOTICE DESCRIBES HOW INFORMATION ABOUT YOU AND YOUR TREATMENT MAY BE USED
AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT

Introduction

Victory Recovery Partners is required by law to maintain the privacy and confidentiality of your health
information and to provide you with notice of its legal duties and privacy practices with respect to your health
information. Please also respect the privacy of others you encounter in treatment.

Collection and Use of Health Information


Victory Recovery Partners collects health information about you with your consent and stores it in an electronic
health record (EHR). This EHR is the property of Victory Recovery Partners, but the information belongs to
you. We adhere to the Health Insurance Portability and Accountability Act (HIPAA) regulations, which require
us to protect the privacy of your medical records and limit the use and disclosure of your information to the
minimum necessary. 

HIPAA and 42 CFR Part 2 Compliance


HIPAA

Under HIPAA, we are required to maintain the confidentiality of your health information and to provide you with
this notice of our legal duties and privacy practices. HIPAA also grants you specific rights, which are detailed
below. 

42 CFR Part 2 

For drug and alcohol treatment information, we follow federal regulations known as 42 CFR Part 2. These
regulations provide additional protections for the confidentiality of information related to your treatment. We
may not disclose these records without your written consent, except in limited circumstances.

 

Uses and Disclosures of Your Information


Under 42 CFR Part 2, the terms of a written consent to disclose information must specify the scope and types
of information to be disclosed, the parties to whom the information may be disclosed, the purpose of the
disclosure and the timeframe of the consent. You may revoke a consent to disclose information relating to drug
and alcohol verbally or in writing at any time.


With Your Consent


We may ask for your written consent to disclose your treatment information for various purposes, including, but
not limited to:


- Sharing information with your other medical providers
- Obtaining payment from insurance or other payors
- Contacting your family for treatment purposes
Victory Recovery Partners will not disclose your treatment information for these purposes without your consent.


Without Your Consent


We may disclose your treatment information without your written consent in certain situations permitted by 42
CFR Part 2, such as:


- Internal use for treatment purposes
- Qualified service organizations that maintain confidentiality
- Outside auditors, regulatory agencies, and evaluators
- Research purposes
- Life-threatening medical emergencies
- Reporting a crime on our premises or against our personnel
- State-mandated child abuse and neglect reporting
- Reporting the cause of death
- Compliance with a valid court order

Your Health Information Rights

- Paper Copy of Notice: You have the right to a paper copy of this notice.
- Access to Records: You can request a copy of your treatment record or to receive your health
information through alternative means or locations.
- Amendment: You can request that we amend your health information if it is incorrect or incomplete.
- Restrictions: You can request restrictions on the use and disclosure of your health information.
- Accounting of Disclosures: You can request a written accounting of all disclosures made by us,
except for those made for treatment, payment, or healthcare operations, and those made to you or your
legal representative.

Recovery Partners (“we”, “us”, “our”, or the “company”) may gather or collect from you in connection with your

This Site is not intended for use by individuals under the age of 18. By using this Site or submitting information

and last name, telephone number, or email address that can be directly associated with a specific person or
entity.

a. Non-Personally Identifying Information: includes your Internet Protocol (“IP”) address, operating
system and browser type, and the locations of the web pages you view right before arriving at, while
navigating, and immediately after leaving this Site.
b. Cookies & Tracking Information: A “Web Cookie” is a string of information that a website stores on
your computer, and your browser provides to this our Site, each time you search this Site. Like many
other commercial websites, Victory Recovery Partners or one of our third-party vendors, including
Google, use Web Cookies to track the pages that you visit during each Site session. Both to help us
improve your experience and to help us understand how this Site is being used and to inform, optimize,

a. Use of Personally Identifying Information: If you choose to provide Victory Recovery Partners with
Personally Identifying Information (for example – by submitting a “Contact Us” form, “Get Help Now”
form, requesting an appointment, or completing a survey) we may use your Personally Identifying
Information to respond to your request for help or provide you with further information about our
services.
b. Disclosure of Personally Identifying Information to Third Parties We may disclose Personally Identifying
Information in the following circumstances:
i. To our related companies and service providers in which we have entered a formal Business
Associates Agreement as defined by HIPAA and 42 CRF Part 2, to perform a business,
professional or technical support function for us;
ii. As necessary if we believe that there has been a violation of the Website Terms of Use or of our
rights or the rights of any third party;
iii. To respond to legal process (such as a search warrant, subpoena or court order) and provide
information to law enforcement agencies or in connection with an investigation on matters
related to public safety, as permitted by law, or otherwise as required by law; and
iv. In the event that our Company or substantially all of its assets are acquired, your personal
information may be one of the transferred assets.
v. We may also disclose your personal information with your express consent for other purposes
not listed here.
vi. We may share aggregate, Non-Personally Identifiable information about Website users with
third parties such as Google Analytics. 

Opt-Out Rights

or mail. You can also unsubscribe from marketing communications using the link provided in our emails.


Website Security


Victory Recovery Partners safeguards the security of the collection, transmission, and storage of the
information we collect. In certain areas of our Website, we use industry-standard TSL-encryption to enhance
the security of the data transmitted. Victory Recovery Partners uses software programs to monitor traffic to
identify unauthorized attempts to upload or change information or other types of malicious use. Information
collected from these sources my be used to help identify and individual in the event of a criminal investigation
or as otherwise required by law.
